HushApp is an application operated by Syneidis, S.L., located in Carrer de Sant Pere Més Alt, 19, Barcelona 08003, Spain. You can reach Syneidis by [email protected]. Syneidis S.L. offer users the service of encryption and transfer of digital content. Users can use the HushApp on their mobile, tablet or desktop device through encryptions on the application. HushApp only serves as the medium to perform all the actions listed before.
These terms and conditions of use ("Terms") apply to the use of the Services of Syneidis S.L including but not limited to HushApp (further on "Services" or "Service") by you and any third party or entity you are using/purchasing the Service on behalf of (together referred to as "You" or "Your"). The Terms and the Service chosen by You are the basis of the agreement between You and Syneidis ("Agreement"). By using the Service or by downloading, installing, signuping, copying or otherwise using the Software, You are consenting to be bound by these Terms.
Terms
By accessing these terms, you are agreeing to be bound by these Terms and Conditions, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this application. The materials contained in this app are protected by applicable copyright and trademark law.
Registration and service
In order to use our Service, you need to complete a registration process. Upon registration you must:
- Provide information ("Registration Data") which is true, current, complete and accurate.
- Update registration data to keep it true, current, complete and accurate.
Users content
You retain full ownership to Your files, folders, including their metadata and any information You submit to Services (together "Your Content").
Your encryption keys are stored in encrypted way and Syneidis S.L. has no access to it. Syneidis S.L. does not store your passphrase and it cannot be restored.
Syneidis S.L. reserves the right to collect and store some information which is needed to run the Service, such as your contact and billing information, email address, messages sent to our support team, etc. in a non-encrypted form.
Security of Users’ content and data
Syneidis does not have an access to your encrypted content therefore you assume full responsibility for it.
Syneidis has no access to your passphrase and it cannot be restored. It is your sole responsibility to remember your passphrase. If you forget your passphrase all your encrypted content will be lost.
The service is as secure as your passphrase and its management, it is your sole responsibility to keep it secret and undisclosed to other parties.
Syneidis does not store or have an access to the encryption key you use to encrypt content.
You hereby agree to the following:
- Not to upload any content or data of third parties protected by copyright, patent, trade secret, trademark or other intellectual property without authorisation.
- Not to upload virus, trojan or any malicious code or software.
- Not to share virus, trojan or any malicious code or software via Services.
- Not to use the Service to store and transfer any unlawful, harassing, libelous, defamatory, racist, indecent, abusive, violent, threatening, intimidating, harmful, offensive or otherwise objectionable content or material of any kind or nature.
- To comply with all applicable Laws.
- Not to use Services to conduct illegal activity,
You acknowledge that content that you send to other Users via Services can be decrypted.
Your account in Services is non-transferable. You agree not to disclose your passphrase and log-in details voluntary with third parties. If you do so, you are accountable for any actions made via your account by another party.

Bare in mind that Syneidis S.L. never sends emails or contacts you by other means with a request to provide your passphrase or password details. If you received such an email, please contact [email protected]
Small Business and Corporate Accounts Management
If your account is part of a Business Account (Small Business or Corporate subscription) the Administrator of this account can modify, edit and access your profile data (including but not limited to: profile picture, contact details, transfer history, etc).
Administrator of your Business Account does not have an access to your passphrase.
Inactive Free accounts
We reserve a right to remove inactive Free accounts if the period of inactivity exceeds 120 days. Activity is understood as upload of new files, removal of files, transferring files to other Users. You will be notified about termination of your account due to inactivity via email.
Permission is granted to temporarily download one copy of the materials (information or software) on Syneidis, S.L.'s application "HushApp", for personal, non-commercial transitory used only. This is the grant of a license, not a transfer of title, and under this license you may not:
Syneidis S.L. grants you a non-exclusive, royalty-free, revocable and, except as expressly provided for in these Terms, non-transferable right and license to use the Software related to the Service ("Licensed Software"), solely in accordance with these Terms. Licensed Software is licensed, not sold.
Your license to use the Licensed Software is automatically revoked if You violate these Terms in a manner that implicates our Service Content.
Permission is granted to temporarily download one copy of the materials (information or software) on Syneidis, S.L.'s application "HushApp", for personal, non-commercial transitory used only. This is the grant of a license, not a transfer of title, and under this license you may not:
- Modify or copy the materials.
- Use the materials for any commercial purpose, or for any public display (commercial or non-commercial).
- Attempt to decompile or reverse engineer any software contained on Syneidis, S.L.'s app.
- Remove any copyright or other proprietary notations from the materials. or
- Transfer the materials to another person or "mirror" the materials on any other server.
This license shall automatically terminate if you violate any of these restrictions and may be terminated by Syneidis, S.L. at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
Disclaimer
The materials on Syneidis, are provided "as is" or "as available". Syneidis, S.L. makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Syneidis, S.L. does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its app or website or otherwise relating to such materials or on any sites linked to the app or site.
Limitations
In no event shall Syneidis, S.L. or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Syneidis, S.L.'s app or website, even if Syneidis, S.L. or a Syneidis, S.L. authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
Revisions and Errata
The materials appearing on Syneidis, S.L.'s app and website could include technical, typographical, or photographic errors. Syneidis, S.L. does not warrant that any of the materials on its app and/or website are accurate, complete, or current. Syneidis, S.L. may make changes to the materials contained on its app and/or website at any time without notice. Syneidis, S.L. does not, however, make any commitment to update the materials.

Syneidis, S.L. has not reviewed all of the sites linked to its app or website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Syneidis, S.L. of the site. Use of any such linked web site is at the user's own risk.
Site Terms of Use Modifications
Syneidis, S.L. may revise these terms of use for its app and website at any time with 15 days notice you receive via email. By using this app and/or website you are agreeing to be bound by the then current version of these Terms and Conditions of Use.
Governing Law
Any claim relating to Syneidis, S.L.'s app and website shall be governed by the laws of Spain, international copyright treaties, conventions and other laws., without regard to its conflict of law provisions.
